dymi1. Acceptance of Terms
Welcome to dymi. By accessing or using our website, applications, and related services (the "Services"), you agree to be bound by these Terms of Service (the "Terms"), which form a binding agreement between you and the operator of dymi. If you do not agree to these Terms, do not use the Services. These Terms are effective as of July 18, 2026.
2. Description of the Service
dymi provides an AI companion service: you exchange text messages with fictional characters powered by artificial intelligence. Characters remember conversations, develop relationships over time, and generate life events. All characters are fictional, AI-generated personas — they are not real people, and no human reads your private conversations in real time or role-plays the character with you.
The Services are an entertainment product. They do not provide medical, psychological, legal, or financial advice, and they are not a crisis service. Anything an AI character says (including expressions of care or affection) is simulated and is not professional advice. If you are in crisis, please contact your local emergency number or a crisis hotline.
3. Eligibility (18+)
The Services are intended only for users aged 18 or older. You must confirm that you are at least 18 years old when registering. Enabling mature mode requires a separate, per-relationship confirmation of age and consent. If we discover an account belonging to someone under 18, we will terminate it immediately.
4. Account Responsibilities
You must provide a true and accurate email address, keep your password and passkeys confidential, and are responsible for all activity under your account. Contact us immediately if you believe your account has been compromised.
You may not transfer, sell, or share your account. We may restrict, suspend, or terminate accounts that provide false information, repeatedly violate these Terms, or pose a security risk.
5. Subscriptions, Billing, and Auto-Renewal
Some features require a paid subscription (e.g. Basic at US$9.99/month, Premium at US$24.99/month) or a one-time purchase of virtual items. Prices are as shown at checkout.
Auto-renewal: subscriptions renew automatically at the start of each billing cycle until you cancel. You can cancel renewal at any time in your account settings or through the payment channel; cancellation takes effect at the end of the current paid period, and you keep subscription benefits until then.
If prices change, we will notify you in advance and the new price applies from your next billing cycle. Cryptocurrency payments are processed by third-party payment processors; blockchain network fees are not recoverable.
6. Refund Policy
Virtual consumables (message credits, date tickets, star sand, decorations, etc.) are delivered immediately and are non-refundable once delivered, except where required by applicable law.
Subscriptions: you may cancel future renewals at any time; fees already paid for the current period are non-refundable except where required by applicable law. For example, EU/UK consumers may have a 14-day withdrawal right for digital content — by starting to use the Services you request immediate delivery of digital content and acknowledge that the withdrawal right is lost once delivery begins. Where your withdrawal right still applies by law, contact us to exercise it.
If you believe you were charged in error, contact support within 30 days of the charge and we will investigate.
7. Virtual Currency and Virtual Items
Star sand, message credits, date tickets, and other virtual items are limited, non-transferable, revocable licenses. They have no cash or monetary value, cannot be exchanged for fiat currency or cryptocurrency, cannot be redeemed or used outside the Services, and cannot be transferred between accounts.
To the extent permitted by law, we may adjust how virtual items are earned and used; virtual items are non-refundable except as stated in Section 6. When an account is terminated, unused virtual items are forfeited without compensation, except where required by applicable law.
8. User Content and License
You retain the rights to the content you submit (messages, character settings, etc.). You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display that content as necessary to operate and improve the Services (including processing by AI model providers).
You represent and warrant that you have the rights needed to submit your content and that it does not violate the law or these Terms. We may remove content that violates these Terms.
9. Prohibited Conduct
You agree not to:
• generate, request, or distribute any sexual content involving minors (zero tolerance; we report to authorities such as NCMEC where required by applicable law);
• use the Services for any illegal activity, or to generate defamatory, hateful, harassing, or privacy-invading content;
• generate sexual content depicting real persons without their consent;
• reverse-engineer, scrape, or access our systems without authorization, or attempt to bypass content-safety systems, usage limits, or paid quotas;
• upload malware or interfere with the normal operation of the Services;
• impersonate others or misrepresent your identity;
• use the Services commercially or resell them without permission;
• "jailbreak" or otherwise induce the AI to produce any of the prohibited content above.
Automated content-safety classifiers may scan relevant content. Violations may result in content removal, feature restrictions, suspension, or permanent termination without refund.
10. AI-Generated Content Disclaimer
Character replies, storylines, and events in the Services are generated by AI models and are fictional. They may be inaccurate, incoherent, or unexpected; they do not represent any real person, professional advisor, or our views. We do not warrant the accuracy, reliability, or appropriateness of AI-generated content — do not rely on it for important decisions.
Emotions expressed by AI characters are simulated. We encourage you to maintain healthy usage habits and real-life relationships and support networks.
11. Service Changes and Termination
We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with advance notice where practicable. You may stop using the Services and delete your account at any time via Profile → Privacy & Data; your data will then be handled as described in our Privacy Policy.
Fees paid by accounts terminated for violating these Terms are non-refundable, except where required by applicable law.
12. Disclaimers and Limitation of Liability
The Services are provided "as is" and "as available." We make no warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, punitive, or consequential damages (including loss of profits, data, or emotional distress). Our aggregate liability for any claim is limited to the greater of the amounts you actually paid us in the 12 months preceding the claim or US$100. Some jurisdictions do not allow these limits; your statutory rights are unaffected.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the jurisdiction in which the dymi operating entity is established (entity details will be updated here upon incorporation). Disputes arising from these Terms shall first be resolved through good-faith negotiation; failing that, either party may bring the dispute before the courts with jurisdiction over the operating entity's location.
If you are an EU/UK consumer, your mandatory local consumer protections are not affected by this section.
14. Changes to the Terms and Contact
We may revise these Terms from time to time. The revised Terms will be posted on this page with a new effective date, and material changes will be announced in advance. By continuing to use the Services after the Terms change, you accept the revised Terms.
